Booking terms and conditions for self-catering accommodations booked through Gites de France Central Reservation Service

Payments of holiday rentals : If you live in France, you can settle your booking by bank cheque, giro cheque , money order to Gîtes de France or credit card. If you live abroad, you can pay by bank draft or international credit card. In both cases, your deposit payment has to be sent with the booking form and the balance with the hiring contract.

Article 1 - These terms and conditions are for the sole use of bookings placed through Gites de France Reservation Service for the Morbihan region in the name of the National Federation of Gîtes de France.
En aucun cas la Fédération Nationale des Gîtes de France ne saurait voir sa responsabilité engagée en cas d'utilisation de ces contrats par des tiers ou à des fins autres que touristiques.

Article 2 - Period of letting : dates and time are clearly stated on the present contract. The client signing the contract has no right whatsoever to remain on the property beyond the termination date of the letting.

Article 3 - Responsibility : The contract is between you (the Hirer), and Gites de France Reservation office who acts as Principle and shall be deemed to be made subject to these booking terms and conditions. Gites de France Reservation office will not be liable for circumstances and third parties forces beyond its control affecting your stay.

Article 4 - Booking confirmation : booking becomes effective when we receive your deposit payment corresponding to 25% of the total cost of your rental (booking fee, cancellation fee -if taken- included) along with a copy of the hiring contract signed by the client, before the deadline stated at the back of the contract.

Article 5 - Balance payment : the balance of the hire will be due for payment to Gites de France Reservation Office, one month before the holiday commencement date. Gites de France reserves the right to cancel a holiday where full payment has not been received on the due date. From then, the accommodation cancelled is quoted as available again to other holidaymakers and your deposit paid on the booking is non-returnable.

Article 6 - Late bookings : less than 30 days before the commencement date will have to be settled when making your reservation.

Article 7 - Payment slip : After full payment has been cashed, Gites de France Reservation Office will issue a receipt to present to the owner/keyholder upon arrival.

Article 8 - Arrival : guests should arrive on the day and time stated on the rental agreement or acknowledgment of booking. In case of delayed or postponed arrival or last minute difficulty, guests should advise the landlord/keyholder whose name and telephone number can be found on the booking slip or description sheet.

Article 9 - Cancellation placed by the hirer : Any booking cancellation has to be made in written by registered letter.
A/ you carry a cancellation insurance : check the terms of your Insurance cover.
B/ You are not covered by a cancellation insurance : for any cancellation placed by the hirer, Gites de France booking office will retain the following amounts from the full cost of the rental (on top of the booking fee not refundable) :
- cancellation placed more than 30 days before the commencement date of your stay : 10% of the cost will be retained
- cancellation placed between 30 days and 21 days before the commencement date of your stay: 25% of the cost will be retained
- cancellation placed between 20 days and 8 days before the commencement date of your stay: 50% of the cost will be retained
- cancellation placed between 7 days and 2 days before the commencement date of your stay: 75% of the cost will be retained
- cancellation less than 2 days before the commencement date of your stay: 90% of the cost will be retained
In case of clients not turning up without warning, no reimbursement will be made.

Article 10 - Substential alteration to the rental agreement : When Gites de France Reservation Service is compelled to make an important change to the letting contract , the client has to be informed by registered letter with AR . The client can then either :
- cancel his booking and be fully reimbursed,
- saccept the changes on the property booked or the offer of alternative accommodation. In which case, an additional clause or new contract will be issued and signed by both parties.
Any rebate will be deducted from the balance if remains. In case the hirer had already paid the full amount due and this amount exceeds the revised cost, Gites de France will pay back the credit balance before the commencement of the stay.

Article 11 - Booking cancelled by the vendor : If Gites de France Reservation Service cancels a booking before the commencement date of the stay , the client must be advised by registered letter with AR.
The buyer, known as the client will receive immediate refund of every money paid . Furthermore, the client will be offered a compensation equivalent to the money he should have paid if the cancellation order was his initiative.
The above agreement dos not apply if the client accepts another accommodation of similar standards from Gites de France.

Article 12 - Failure to fulfill the letting contract : should Gites de France be in the situation where they cannot comply wit the terms of the rental agreement, fail to supply the services expected per contract, representing a significant percentage of the amount paid by the client, our Booking Office will propose an alternative accommodation. In which case, any extra cost will be supported by Gites de France. If a lesser cost, the client will get the refund of the extra money he has paid before termination of his stay.
In case Gites de France cannot offer an alternative accommodation or the offer is rejected by the client, the latter will receive a compensation based on the amount he should have paid in case he had cancelled himself.

Article 13 - Interruption of stay : If the case of the client, he cannot claim any money back unless otherwise stated by his cancellation insurance.

Article 14 - Party number : the maximum number of persons allowed is stated on your hiring contract. The Owner or representative has the right to refuse to admit more than the number of persons allowed in the accommodation booked . Any change or breach of contract will be the client's responsibility.

Article 15 - Pets : your hiring contract confirms if pets are accepted or not in the accommodation booked. In case of non-respect, the owner or representative can refuse the let. In which case, no refund will be made to the client.

Article 16 - Contract transfer : the buyer can transfer his booking to another person that meets the same conditions. In such case, the initial buyer known as the client has to advise Gites de France Booking Office by registered letter with AR 7 days before commencement of the stay at the latest.
The contract transfer has to be made at cost price.
The initial buyer and the one taking over are jointly liable to the vendor (Gîtes de France) for the balance payment and any additional cost incurred by the transfer.

Article 17 - Insurance cover : All damages and breakages are the legal responsibility of the Hirer. It is strongly recommanded to take up a comprehensive holiday insurance policy.

Article 18 - Property inspection : An inspection is carried out in the presence of the hirer and the owner both upon arrival to the gite and before departure. The inspection certificate is the only valid document in the event of a dispute arising between parties over the inspection.
Guests must maintain and leave the property and its contents clean and tidy. Before your departure, the owner or representative will check the state of the gite. If necessary, a cleaning fee will be charged based on the cost detailed on the description.

Article 19 - Security deposit : A security deposit will have to be paid on arrival to the owner/keyholder. The amount is specified on the description sheet of the accommodation. After inspection, it will be returned to you at the end of your stay minus the cost of breakage or damage if noted.
In case of advanced departure (prior to the times indicated) and impossibility to carry out the inspection the day of departure, a refund of the deposit will be made within a week.

Article 20 - Payment of extra charges : At the end of the stay, the client must pay to the owner or representative any extra charges not included in the rental cost. The price is calculated based on the price scale indicated on the property details and a proof of payment will be given to the client.

Article 21 - Dispute : Any claim linked to the inspection or the description of the accommodation has to be placed with Gites de France Booking Office within 3 days after arrival on the property.
Any other claim has to be made in writing as soon as possible. In case of unsolved dispute, claims can be referred to the Customer and Quality Service of the National Federation of Gîtes de France in order to find an out of court agreement.
When Gîtes de France Booking Office substitutes for the owner in case of client's compensation, the client accepts to consider Gites de France as the subrogator of the owner regarding his rights and actions .
